Italy Ambassador has got No Immunity in Court, rules Supreme Court

Supreme Court of India has ruled that Italian Ambassador Daniele Mancini has got no immunity in the Court. A Bench of Chief Justice Altamas Kabir and Justices Anil R. Dave and Ms. Ranjana Desai ruled that the Ambassador approached court as a petitioner and hence cannot claim any immunity.

“A person who has come to court as a petitioner, I don’t think he has any immunity. Some people are writing that we are naïve. What do they think about our judicial system? We don’t expect the Republic of Italy to behave like this. He [Ambassador] has lost the trust”, said Chief Justice.

The Bench further noted that its previous order has not been violated yet, as the deadline for Marines to return is not yet over. The Court was not concerned about  what  the two Governments communicate.

The Bench further fixed the date of next hearing to April 2  and the Italian Ambassador cannot leave the Country until its further orders. The court also directed authorities that its orders are brought to compliance.
