What India can do if Italian Marines do not Return back ?

Since Last Night the news went viral that the two Italian Marines wont return back, the gossips in Indian Political corridors have been high  and all eyes are set upon the next move by UPA Government Chaired by Sonia Gandhi, who has ancestral roots in Italy.

An Official Statement said, “Italy has informed the Indian government that, given the formal initiation of an international dispute between the two states, the marines Massimiliano Latorre and Salvatore Girone will not return to India at the end of their home leave.”.

In Italy, the two marines were ready to come back for trials on March 23, but were restrained by the newly elected Government. According to an Italian daily, they shall resume their duty soon, having acquired a celebrity status in Italy.

Now, let’s investigate what are the options before India. Can it legally force Italian Government to send them back ?

1. International Court of Justice

 India can take this matter to International Court of Justice as this is a strict contempt against the Supreme Court of India where the two Marines had formally declared to return back before being allowed to go back to Italy.

Also India has repeatedly maintained that a crime had been committed against Indian citizens on an Indian ship and hence India had the jurisdiction to prosecute and try the case.

2. Scrap all Diplomatic Ties

Not sending back the two marines is a severe insult to the largest democracy in the World. India should call back its Ambassador to Italy. Italy has already called back its ambassador to India for “consultations” after a charge sheet for murder was filed against two Italian Marines.

The two Marines have committed crime according to Indian Laws and are therefore a Convict in Legal terms. Providing shelter to Convicts is a sufficient grounds to scrap all ties with Ital

3. Scrap Defense Deals

India has been a major market for Italian Defense Firms like AgustawestLand which have been dealing with Multi-Billion-Dollar Deals with India.  If India scraps any such defense Deals, a subtle pressure would be put upon Italian Government to send those marines back

4. United States’ Intervention:

This would be a feebly weak step for India. United States is not at fruitful terms with Italy ever since Iraq War. Italy was first country to withdraw its troops from Iraq in 2006. Also, seeking US  help would indicate that India is unable to handle its diplomatic affairs on its own

5. War 

The Last and a very controversial option is War with a Italy for defending the Repute of the largest Democracy of the World and honoring the decision of Indian Court. India has World’s largest Military Trooper. Its Defense Budget is considerably larger than that of  Italy. India being 10 times larger than Italy in terms of Area and 20 times larger in terms of Population cannot bear this Diplomatic Insult on International level.

Despite all this, it can be argued that the present Indian Government can think of this extreme step provided its repute of a weak foreign policy. However if it fails to bring back those two Marines, the Political Opponents would get a Readymade tool to bring down the Government. There has already been gossips of Conspiracy behind sending those Marines to Italy twice in such a short interval. The UPA  government has, through its acts of omission and commission, created the circumstances for such an outcome, perhaps because it did not want to be seen to be striking deals with the Italian government.
